By-Laws

ARTICLE I   ORGANIZATION

  1. The name shall be South Central Association of Neighbors (SCAN), hereafter “SCAN.”

  2. The Neighbors will have a fiscal year beginning 1 July of each year, ending 30 June of each year.

  3. The Neighbors will not discriminate on the basis of race, color, national origin, sex, sexual preference, marital status, age, religion, creed or political belief, mental or physical ability, or status as a veteran in admission, access to, or conduct of its meetings. 

  4. Harassment based on race, color, national origin, religion, sex, gender, sexual orientation, age or ability is a form of discrimination and is prohibited. 

ARTICLE II   MISSION

The mission of SCAN is to promote and preserve the qualities that make our historic neighborhood special and distinctive to its residents and to the city of Bozeman. Our primary goals are: to unify neighbors with effective communication, enable residents to address issues that affect the quality of life in the area, and to review and recommend possible policies, plans, or action to the appropriate boards or agencies on any matter affecting the Neighbors.

ARTICLE III   NEIGHBORHOOD BOUNDARIES

Neighborhood boundaries cover the area from Main (south side of the street) to Cleveland (north side of the street) and from South 3rd(both sides of the street) to South Black (both sides of the street), but SCAN welcomes participation from residents from neighboring streets with possible future inclusion.

ARTICLE IV   MEMBERSHIP

  1. Membership shall be open to any person who owns or rents property in the neighborhood, who is at least 18 years of age. Organizations and businesses located in the neighborhood are also eligible for membership.

  2. Voting membership shall be granted to any personwho meets the above criteria. Only one person per property can vote (one property = one vote). 

  3. A meeting quorum of nine (9) SCAN members is required to conduct business and/or vote. Voting may be conducted at annual meetings by a show of hands, voice, ballot or by proxy with paper ballots returned to members of the Steering Committee. 

  4. Voting also may occur between annual meetings electronically via email or online survey tool or via in-person meeting when warranted, according to the procedures noted in this section.  Votes shall be collected, tallied, and recorded with date and outcome, shared with the City’s neighborhoods coordinator and filed with SCAN’s permanent archive.

  5. A simple majority vote (51 %) of those in attendance or voting by proxy will pass a resolution. The number of votes for and against a resolution shall be recorded in the official minutes of the meeting. 

ARTICLE V   MEETINGS

 

  1. The annual membership meeting of the Neighbors shall be held any date during the Fall season each year, between the hours of 8:00 A.M. and 10:00 P.M. Mountain Time. SCAN will hold a minimum of one meeting per fiscal year, in or near Bozeman, MT, at a specified location. Meetings will be open to the public. 

  2. All meetings will be publicized in the neighborhood using whatever reasonable means is available, but not limited to: the website, flyers, postal mailings, e-mails or telephone. 

ARTICLE VI   OFFICERS AND DUTIES

  1. The regular work of the association will be carried out by a Steering Committee, which shall consist of seven elected members chosen at the annual meeting. The elected members of the Steering Committee will share duties and form subcommittees as needed. Committee members will select the Chairman of the Steering Committee and other pertinent positions (i.e. Treasurer, Secretary, etc.). The primary responsibilities of the Steering Committee include but are not limited to the following: organizing annual meetings, addressing issues as they arise in the neighborhood, insuring representation at meetings of the Inter-Neighborhood Council, maintaining open channels of communication with the neighbors and the city. 

  2. Nomination, election, and terms of Steering Committee. Members may nominate candidates for the Steering Committee, or members may nominate themselves. Every candidate must accept the nomination. Nominees will be announced in the call to the annual meeting, but nominations will also be accepted from the floor. The term of office is one year, but Members may serve for no more than two (2) consecutive terms. The Committee Secretary will notify the City of Bozeman Neighborhood Coordinator in writing of the names of the newly elected officers, their term, addresses, telephone numbers, and date they are due to take office. 

ARTICLE VII   FUNDING

SCAN may, when called for, charge fees of neighbors or the public for participation in events and activities to cover the cost of any venue rental and equipment, speaker fees, printing and any other charge SCAN may incur.

 

ARTICLE VIII   INTER-NEIGHBORHOOD COUNCIL

  1. SCAN shall appoint one representative to serve on the City’s Inter-Neighborhood, Council, an advisory board to Bozeman’s City Commission.  An alternate also shall be appointed to attend INC meetings and raise and participate in discussion and be authorized to register any votes on behalf of SCAN in the representative’s absence.

  2. The representative and alternate shall be appointed by the SCAN Steering Committee. The representative shall serve a two-year term, and the alternate shall serve a one-year term.  Delegates may be reappointed and need not be SCAN Steering Committee members.
